Buying your first home is one of the most significant financial decisions you will ever make. It is also one of the most complex. Between mortgage applications, home inspections, appraisals, and legal documents, the process can feel overwhelming. This guide focuses on the part of the transaction that many first-time buyers know the least about: title and settlement.

What Is a Title Company and What Do They Do?

A title company is the neutral third party that handles the legal and financial mechanics of your home purchase. At Simplicity Title, our role includes:

  • Conducting the title search -- examining public records to confirm the seller has the legal right to sell and that no hidden claims exist against the property.
  • Issuing title insurance -- a one-time policy that protects you and your lender against ownership defects.
  • Managing the closing (settlement) -- coordinating document signing, fund transfers, and deed recording.
  • Holding escrow funds -- securely managing your earnest money deposit and closing funds.

Understanding Your Closing Costs

Closing costs are the fees and expenses you pay at settlement, on top of your down payment. For a first-time buyer in NJ or NY, total closing costs typically range from 2% to 5% of the purchase price. Common costs include:

  • Title insurance premiums -- both owner's and lender's policies
  • Title search and examination fees
  • Attorney fees -- for contract review and closing representation
  • Recording fees -- charged by the county to record the deed and mortgage
  • Transfer taxes -- paid by the seller in most NJ transactions, but buyers should be aware of them in NY transactions
  • Mortgage recording tax -- applicable only in NY (not NJ)
  • Lender fees -- origination charges, appraisal, credit report
  • Prepaid items -- homeowner's insurance, prepaid interest, property tax escrow
  • Survey fee -- if a new survey is required

First-time buyer tip: In New Jersey, first-time homebuyers may qualify for a partial exemption on the Realty Transfer Fee. Ask your attorney or title company if you are eligible.

The Timeline: What Happens When

  1. Contract signed: You and the seller agree on price and terms. In NJ, a 3-business-day attorney review period begins.
  2. Earnest money deposit: You provide a deposit (typically 1-3% of the purchase price) held in the title company's or attorney's escrow account.
  3. Home inspection: You hire an inspector to evaluate the property's condition.
  4. Mortgage application: You formally apply with your lender, who orders an appraisal.
  5. Title search: The title company examines the property's ownership history.
  6. Mortgage commitment: Your lender issues a commitment letter confirming your loan approval.
  7. Closing Disclosure: You receive your Closing Disclosure at least 3 days before closing.
  8. Final walkthrough: You inspect the property one last time to confirm its condition.
  9. Closing day: You sign documents, wire funds, and receive the keys.

Protecting Yourself from Wire Fraud

One of the biggest risks for first-time buyers is real estate wire fraud. Criminals impersonate title companies and send fake wiring instructions via email. Before wiring any funds, always call your title company at a number you obtained independently (not from an email) to verify the bank account details.
